This Privacy Policy describes the current policies and practices of Central Garden & Pet Company, the parent corporation of Kaytee and SuperPet, ( “CG&P”) with regard to Personal Data collected by CG&P through its website, www.petfundango.com (hereinafter referred to collectively as "CG&P Website"). The term "Personal Data" refers to personally identifying information about you, such as your full name, birth date, e-mail address or mailing address, and any other information that can be used to identify or contact you. The term “Kid” refers to a user under the age of 13, and the term “Parent” refers to a parent or legal guardian of a Kid. The term “User” refers to any user of the CG&P Website.

Collection of Personal Data from Kids. We recognize the need to provide additional privacy protections when dealing with the Personal Data of Kids. Our collection practices are in compliance with the Children’s Online Privacy Protection Act (“COPPA”).

Who Collects Personal Data. CG&P is the operator of the CG&P Website under COPPA, which means that it is CG&P who collects, owns and controls Personal Data on the CG&P Website. Here is CG&P ’s contact information:

Consent From a Parent Required under COPPA. COPPA requires CG&P to obtain a Parent’s prior consent before collecting, using or disclosing any Personal Data from a Kid, unless any of the following exceptions under COPPA apply.

Exceptions. Prior consent from a Parent is not required for CG&P to:

  • collect a Kid’s or Parent’s email address to provide notice to the Parent requesting the Parent’s prior consent to the collection, use or disclosure of a Kid’s Personal Data;
  • collect an email address to respond to a one-time request from a Kid and then delete the email address;
  • collect a Kid’s email address to respond to more than one specific request, such as for a subscription to a newsletter, provided that CG&P notifies the Parent that CG&P has communicated once with the Kid and gives the Parent an opportunity to stop subsequent communications;
  • collect a Kid’s name or online contact information to protect the safety of the Kid, provided CG&P notifies the Parent and gives the Parent the opportunity to prevent further use of the information;
  • collect a Kid’s name or online contact information to protect the security or liability of the CG&P Website or to respond to law enforcement, provided that CG&P does not use the information for any other purpose.

In addition, COPPA requires CG&P to: (1) request new consent from a Parent in the event that there are material changes in the collection, use or disclosure of a Kid’s Personal Data collected on the CG&P Website; (2) offer a Parent the option to agree to the collection and use of a Kid’s Personal Data by CG&P without consenting to the disclosure of the information to third parties; (3) collect and use only the information that is reasonably necessary to participate in an activity; and (4) allow a Parent to review a Kid’s Personal Data, ask to have it deleted and/or refuse to allow further use of it at anytime.

Personal Data Collected. The only Personal Data CG&P currently collects through the CG&P Website is the information voluntarily given to us by a Parent, Kid or other User. CG&P does not require a Parent or a Kid to disclose more information about a Kid than is reasonably necessary for a Kid to participate in a particular activity or feature of the CG&P Website, and may not do so under COPPA. CG&P does not collect any Personal Data about a Kid without a Parent’s consent unless one or more of the COPPA exceptions apply.

In order to enter our contests and participate in other programs we offer from time to time, all Users must first submit an email address. Kids are required to submit a Parent’s email address, which will then be used to obtain consent when required. For more information on the consent and notice procedures, including the steps we take to ensure we are communicating with a Parent, please see the “Procedure for Obtaining Consent” section below. A Parent may then voluntarily submit a Kid’s or other User’s Personal Data, including first and last name, address, city, state, zip code, country, email address and birthday, in order to sign a Kid or other User up for our Fan Club or to allow the Kid or other User to participate in contests and other programs. A Kid, Parent or other User may also submit an email address to us to ask us a question.

When a Kid or other User uses the CG&P Website to search for information, the Kid or other User is not providing us with any Personal Data. We offer the search features as a service to Kids, Parents and other Users. CG&P does not collect or retain any Personal Data about anyone who uses the search features. Non-Personal Data, however, may be collected as a Kid or other User searches the CG&P Website. The collection of Non-Personal Data is described below.

Non-Personal Data Collected. Other data that does not qualify as Personal Data because it cannot be used to contact or identify Users (“Non-Personal Data”) may also be collected when a Kid or other User participates in certain features of the CG&P Website, or may be automatically collected about the Kid or other User. For example, when a Kid submits an essay, CG&P may collect the Kid’s first name, grade, school and state.

In addition to the information voluntarily provided by a Kid, Parent or other User, CG&P may use technology to collect Non-Personal Data about the use of the CG&P Website. For example, we use technology to track how many visitors access the CG&P Website, the date and time of their visit, the length of their stay, and which pages they view. We also use technology to determine which web browsers our visitors use and the address from which they accessed the CG&P Website (for example, if they connected to the CG&P Website by clicking on one of our banner ads).

This technology does not identify any User personally. It simply enables us to compile statistics about our visitors and their use of the CG&P Website. CG&P uses this Non-Personal Data and may share it with third parties to improve the content and functionality of the CG&P Website, to better understand our customers and markets, and to improve our products and services.

Procedure for Obtaining Parental Consent. When consent from a Parent is required under COPPA, CG&P first collects a Parent’s email address for the purpose of obtaining consent. CG&P will then send an email to the Parent. The email will include: the same information contained in this Privacy Policy; a notice that CG&P wishes to collect the Personal Data; a notice that a Parent’s consent is required by law for the collection, use and disclosure of the Personal Data; and instructions on how the Parent may provide consent. In general, a Parent may provide consent by return email including the requested Personal Data. If no return email is received from the Parent within 48 hours, CG&P will delete the email address from its data collection and management system. If CG&P receives a return email providing consent, it will wait at least 24 hours and then send a confirmation email to the Parent thanking the Parent for allowing the Kid or other User to join and offering the Parent a final opportunity to revoke or deny consent by return email or telephone. If no email or telephone call denying or revoking consent is received within 48 hours, CG&P will then enter the Kid’s Personal Data into its data collection and management system and begin offering the Kid or other User the services covered by the consent.

Use of Personal Data Collected. CG&P uses Personal Data to provide Kids and other Users with the requested services, and to offer Kids and other Users opportunities to receive additional information, products or services from CG&P. If a Kid or other User emails CG&P with a question, CG&P may use the entered email address to contact the Kid or other User with an answer to the question, but will then delete the email address unless a Parent has consented to further use of the email address. If a Kid or other User enters an email address to participate in a contest, CG&P will use the email address to notify the winner of the contest, but will then delete all email addresses collected in connection with the contest.

In addition, CG&P may publish certain Non-Personal Data about Kids on the CG&P Website. For example, if a Kid enters an essay contest, CG&P may publish the Kid’s first name, grade, and state on the CG&P Website in connection with the essay. CG&P does not publish any Personal Data about Kids or other Users on the CG&P Website.

New Consent Required for Material Changes in Collection Practices. CG&P will request new consent from a Parent in the event that there are material changes in the collection or use of Personal Data collected on the CG&P Website. Such material changes in CG&P’s collection practices will also be reflected in updates to this Privacy Policy, and CG&P encourages all Users to periodically review this Privacy Policy.

Separate Consent for Third Party Disclosures. CG&P does not currently disclose any Personal Data to third parties. If CG&P decides to do so in the future, CG&P will obtain specific consent from Parents for that purpose. If a Parent has already consented to other uses of Personal Data, CG&P will still seek additional consent if it wishes to disclose the Personal Data to third parties. A Parent has the option to agree to the collection and use of Personal Data by CG&P without consenting to the disclosure of the information to third parties.

Review and Opt-Out. A User or Parent can review his/her or his/her Kid’s Personal Data, ask to have it deleted and/or refuse to allow further or certain uses of it at anytime by sending a request via email to customerservice@kaytee.com or calling us at 1-800-669-9580. If a Parent asks to review the Personal Data of a Kid via email, CG&P will take extra steps to verify that it is the Parent making the request. For example, CG&P may respond to the email requesting that the Parent call CG&P to verify that he or she wishes to review the Kid’s Personal Data.

Security Measures. CG&P uses industry standard security measures to protect your Personal Data. While such security measures provide reasonable protections against unauthorized access, they provide no guarantee that your Personal Data will not be compromised.

Link to Other Sites. This Privacy Policy applies only to the CG&P Website. The CG&P Website contain hyperlinks to websites that are not operated by CG&P. These hyperlinks are provided for your reference and convenience only and do not imply any endorsement of the activities of these third-party websites or any association with their operators. CG&P does not control these websites and is not responsible for their data practices. We urge you to review the privacy policy posted on any site you visit before using the site or providing any Personal Data about yourself.
